Guidance Issued on Implementing Tariff Related Elements of U.S. - European Union Framework Agreement

On September 24, 2025, U.S. Customs and Border Protection (CBP) issued guidance in CSMS# 66336270 on the implementation of the U.S. – European Union (EU) Framework Agreement.  The notice updates Section 232 duties for certain EU products based on their most favored nation (MFN) duty rates.

Automobiles

  • 9903.94.50 MFN duty greater than or equal to 15%, Section 232 rate is zero (0)
  • 9903.94.51 MFN duty less than 15%, Section 232 rate is 15%

Auto parts

  • 9903.94.52 MFN duty greater than or equal to 15%, Section 232 rate is zero (0)
  • 9903.94.53 MFN duty rate less than 15%, Section 232 rate is 15%

Drawback CBP provided guidance for entry filing requirements specific to EU automobiles and auto parts.

Entry corrections For automobiles and auto parts, entry corrections under HTS 9903.94.50 and 9903.94.53 may be filed retroactively to August 1, 2025. 

Civil Aircraft Effective, September 1, 2025, civil aircraft products are no longer subject to reciprocal tariffs or Section 232 aluminum, steel and copper tariffs.  Use HTS 9903.02.76 for declaration.

Reciprocal Tariff Exemptions EU-origin products aluminum, steel, copper, automobile and auto parts remain exempt from reciprocal tariffs.  Additional exemptions effective September 1, 2025, include:

  • 9903.02.74 Unavailable natural resources (e.g. cork)
  • 9903.02.75 Essential oils for religious use
  • 9903.02.77 Non-patented pharmaceutical products 

Importers should provide supporting documentation at time of entry to support an exemption claim for religious use and non-patented pharmaceutical products. These documents should be kept on file for record keeping purposes.

ACE Updates Tariff modifications will be available in ACE starting September 25, 2025. Importers should use the updated HTS for new and post-summary corrections.
